Welcome to Felse. By accessing or using our mobile application or web service, you agree to comply with and be bound by the following Terms of Service. Please read them carefully.

1. Acceptance of Terms

a. This is an agreement between you and Felse regarding your use of the Felse app. By downloading and using the application, you agree to these terms. If you do not agree to these terms, do not use the Felse app and request a deletion of your account.

b. By using this app, you also agree to Apple’s Standard Terms of Use (EULA), which govern the licensing of this application. You can review the full terms here: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

2. User Obligations

a. The user is solely responsible for the use of the application. It is the user’s decision whether to share their recorded and stored data with other Felse users. User agrees to provide accurate and complete information when creating their profile. Users below the age required by the app’s age rating are not permitted to use the app.

b. The user agrees to refrain from any actions that impair or may impair the functionality of Felse’s services (e.g., through software, scripts, data manipulation, or other hacks).

c. The user is obligated to immediately notify us of any misuse of their password or user account, as well as any other breach of security regulations, and is liable to Felse for any misuse of their user account caused by them.

d. Felse is intended exclusively for private and non-commercial use. Users thereby agree to use the application only for private purposes. Commercial use of the software is only possible with our permission.

e. The sale or transfer of the user account to third parties is not permitted.

f. The user undertakes not to use a profile name that violates the rights of third parties or violates legal regulations or common decency. We reserve the right, at our sole discretion, to delete profiles that may be illegal or offensive.

3. Privacy

a. Protecting your privacy is important to us. Please review our Privacy Policy to learn about the information we collect and how we use it.

4. Prohibited Activities

a. You agree not to use the app for any unlawful purposes or in any way that could damage, disable, overburden, or impair the app’s functionality.

5. Content

a. Users acknowledge that Felse assumes no responsibility for content that we did not create ourselves or that we have not acknowledged.

b. By publishing content on Felse, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display this content in the Felse app.

c. With the exception of injury to life, limb, or health and the breach of essential contractual obligations (cardinal obligations), Felse is only liable for damages resulting from intentional or grossly negligent conduct. This also applies to indirect consequential damages, such as, in particular, lost profits.

d. The limitation of liability in these terms and conditions also applies mutatis mutandis to Felse’s employees and vicarious agents.

e. Claims for liability under mandatory national law remain unaffected.

6. Termination

a. We reserve the right to terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the terms.

7. Limitation of Liability

a. Felse is provided “as is” without warranties of any kind. We are not liable for any damages arising from the use or inability to use the app.

b. Users have no right to expect that the service, its content, and functions will change or remain unchanged.

c. Likewise, there is no right to expect that the service will always be accessible and available, or to function error-free. Furthermore, Felse reserves the right to discontinue the service or parts thereof.

d. The activities offered in Felse (e.g., meeting, traveling together, learning languages) are intended for entertainment, personal development, and social engagement. Participation in these activities, including meeting with other users or engaging in travel, is at the user’s own responsibility and risk.

e. Felse assumes no responsibility for any actions undertaken by the user while participating in or completing activities facilitated by the app. The app is not liable for any damages, injuries, losses, disputes, or legal consequences that arise directly or indirectly from meeting with other users, traveling together, or any other activity arranged through the app.

f. Users are encouraged to always act responsibly when interacting with others and engaging in any activities suggested or arranged through the app. This includes respecting their own health, safety, and well-being, as well as the rights and safety of others. Felse makes no express or implied representations or warranties regarding the suitability, safety, or appropriateness of the activities or encounters facilitated by the app.

8. Costs

a. The purchase and use of Felse is generally free of charge. However, the range of functions is limited in the free version. The full range of functions can be obtained by purchasing a subscription. The purchase process, cancellation, and refund of subscriptions and in-app purchases is handled exclusively by Apple Inc. and is beyond the control of Felse. Notice periods can be found in Apple Inc.’s Terms and Conditions.

b. Use of the app may result in additional costs from the service provider on the user’s side, which are beyond the control of Felse.

9. Recommendation

a. Recommending the Felse app can lead to upgrades. A new user must be a new customer who has not yet had contact with Felse. Recommendations can be made within a limited period of time after account creation and must be initiated by the recommended user. A successful recommendation requires active daily use of the app in the following days.

b. Felse will decide at its sole discretion whether an recommendation meets the required criteria and whether or not to award a reward. There is no legal obligation to award rewards. Felse assumes no liability for any losses resulting from the non-awarding of rewards.

10. Affiliate

a. Some links in the application may be affiliate links. These links are generated generically and do not contain any information about the user. A cookie is set on the respective landing page that identifies Felse as the source. This cookie is outside of Felse’s control.

11. Third-Party Offers

a. Felse reserves the right to cooperate with third-party services (e.g., independent applications, advertising, etc.) and to promote paid third-party offers within the application.

b. If the user uses third-party offers, we become neither a contractual partner nor a vicarious agent. The third party’s terms and conditions apply. Felse is not obligated to provide services in this context.

12. Supported Devices

a. Felse is optimised exclusively for the latest Apple operating system and the latest device generations. Older or other operating systems and devices may have bugs, lack features, or be removed from the App Store.

13. Changes

a. We reserve the right to modify or replace these terms at any time.

b. We will inform users in advance of any changes to the Terms of Use via the email address provided during account creation. We do informe you that the changes will be deemed accepted if no objection is received by email within three weeks of notification.

c. Continued use of the app after the effective date constitutes acceptance of the revised Terms.

Privacy Policy

This Privacy Policy describes how Felse collects, uses, and shares your information when you use the Felse app.

1. Information We Collect

a. We collect information you provide directly to us, such as your email, password, age, gender, sexual orientation, languages learned and spoken, profile photos, and other optional preferences like partner search criteria, height, and interests.

b. We also collect information automatically when you use the app, including your last online location, last active date, and other activity data necessary to provide the service and its features.

2. Data Storage and Security

a. All profile information is stored in a secured database, not accessible publicly.

b. Shared data like photos and messages are encrypted and stored on cloud servers.

3. Data Usage

a. We use your information to facilitate connections within the app, such as matching you with other users based on your preferences and travel itineraries.

b. We may use the information we collect to provide, maintain, and improve Felse, to communicate with you.

c. Felse does not use collected data to personalize your experience.

4. Data Sharing

a. We do not share your personal information with third parties except as necessary to provide the app’s services or as required by law.

5. Cookies

a. We do NOT use cookies and similar tracking technologies to track activity on Felse.

6. Data Retention

a. We retain your information for as long as your account is active or as needed to provide you services. Any undelivered messages or other data such as connection invites are deleted after a period of time.

b. You may delete your account at any time through your account settings. By requesting deletion, all data will be irrevocably deleted. Deleting a user account will result in the disconnection from the respective connected users and groups.

c. Deleting the app does not cancel the subscription; it will continue to exist.

d. If the user is inactive for an extended period of time, Felse reserves the right to irrevocably delete the user’s data.

7. Performance-Related Data Retention

a. Felse reserves the right to delete certain user data records if the number of stored data records exceeds a specified limit in order to ensure the best possible performance and functionality of the app. Felse makes this decision at its sole discretion and endeavors to delete the data records least relevant to the user first.

8. Your Rights

a. You have the right to access, modify, or delete your personal information at any time through your account settings.

9. Security

a. We take reasonable measures to help protect your personal information from unauthorized access, alteration, or destruction.
